Introduction
A matchless setting for feature film, television commercials and still photo shoots, Alaska’s wilderness is more accessible and less expensive to commercial filming than some standard back lots. As commercial filmmakers, you’ll find Alaska a remarkably easy place to work. Because the state’s population is relatively small - and Alaskans value their independence so highly - you’ll find fewer rules, regulations and limitations here than just about anywhere else in the Lower 48 states or Canada.


Permits/visas
Permits and/or fees are required for filming on most public lands, including state and national parks. Scouting permits may also be needed. Lands owned by Alaska Native regional, village, and urban corporations are private lands and any commercial visitors require prior official approval of the landowner. Permission is generally required for filming on Native lands, and some fees may also apply.

Tax breaks/incentives
There is no state income nor sales tax in Alaska. However, some Alaska communities impose a local sales tax, which may typically range from 0%-5%.

Introduction
The California Film Commission supports film, TV and commercial productions of all sizes and budgets, with a variety of services, including our extensive digital location library, free on-line permitting, low cost use of state properties as shooting locations, and production assistance. Filmmakers also receive logistical assistance from California's network of over 50 local film offices taking advantage of the diverse landscape of California including rugged coastlines and giant redwood forests, high mountain ranges, desolate desert scenery, quaint towns and gritty urban centers. California has moderate weather with 315 sunny days per year coupled with the largest and most talented film crews in the world. In addition, the state offers over 500 stages and state of the art production and post-production facilities.

Colorado does not require a State film permit, although the Film Commission is an ideal contact to assist productions in securing access to the spectacular locations offered throughout the State. The Colorado State Patrol requires a special events permit on State highways, with a $25.00 permit fee; in addition, Denver requires a film permit that is free of charge. In conjunction with a network of community contacts and local film commission offices, the State Film Commission works with the appropriate agency contact necessary to obtain the correct Federal, State, County or City permits for the project. Introduction
The Hawaiian Islands have everything filmmakers want, offering beautiful sites, exceptional weather, experienced crews, top notch equipment and ethnically diverse talent. There are also tax credits, a visa waiver program, a comprehensive production directory, and a State-run studio.


Permits/visas
A network of State and County film commissions (known collectively as the Film Offices of the Hawaiian Islands) help streamline the permit process. They understand production, provide free assistance, and act as liaisons between the filmmaker and various government agencies in order to obtain the film permits necessary to shoot on public lands.

Tax breaks/incentives
We have a 15-20% refundable tax credit based on a production company's Hawaii expenditures while producing a qualified film, television, commercial, or digital media project. We also have a 100% high technology business investment tax credit. Please see our website for more details.

Tax breaks/incentives
Idaho offers a sales tax rebate on tangible property used in a production, sales/bed tax waivers with a 30+ day stay and a new cash rebate of 20% on below-the-line in-state spend. Both the sales tax rebate and the 20% cash rebate are subject a minimum spend; the cash rebate requires local crew hire and is subject to qualifications and availability of rebate funds. Permitting requirements is decided by landowner/business owner. Permits required for state-owned locations. Each location handles their own permitting, but to gain an understanding it's recommended to go through Film Indiana as a starting point.

Media Production Expenditure Tax Credit (effective from July 1 2008) - up to 15% refundable tax credit for qualifying productions and associated local spend; Sales Tax Exemption - purchases of tangible personal property are exempt from Indiana sales tax if the property was bought for direct use in a film, television, short, or documentary production in Indiana. Applies to purchases associated with pre-production, production, and post-production; Lodging Tax Exemption - persons renting a hotel room for at least 30 days may be exempt from the hotel lodging tax.

Introduction
Our State is your stage. The Kansas Film Commission works exclusively to assist production companies when shooting on-location in Kansas. Services include location scouting, accommodations, pre-production needs, personnel and support services. We also provide liaison assistance and information on State laws pertaining to film production. Our production guide provides listings for community representatives, crew companies, equipment needs and supplies a multitude of additional resources offered in Kansas. The Kansas Film Commission will provide liaison services and assist with all jurisdictions throughout Kansas. Production companies will receive complete assistance to obtain appropriate permits when shooting on-location in our State.

Maine has no required State-wide permits and few local or regional ones. Permitting in Maine is usually quick, easy and inexpensive (and often, free!).

Montana has no State filming permit, however many of the State and federal agencies such as State parks and the National Forest Service do require permits. The Montana Film Office can act as your liaison with all of the various agencies.

Montana offers a 14% refundable tax credit based on hired Montana labor. It applies to first $50,000 of wages per Montana resident. The state also offers 9% refundable tax credit based on qualified expenditures. The rebate includes all qualified in-state expenditures directly related to the production. It also includes per diem. Introduction
New Jersey boasts an outstanding variety of locations, which have been used to simulate many different periods and settings. HUDSON and ESSEX COUNTIES are urban, industrial areas in close proximity to New York City. Hudson County offers factories, apartment and row housing, and period bridgework. Jersey City, the second largest city in New Jersey, has a highly built-up downtown, with older and contemporary office buildings and retail shops. Its Journal Square area is New Jersey’s version of Times Square. The brand new Prudential Center, home to the New Jersey Devils, is a beautiful, state-of-the-art arena. The busy Newark International Airport serves the entire metropolitan area. Essex County also contains many attractive suburban communities including Montclair, a highly popular film location. BERGEN, MIDDLESEX, UNION and PASSAIC COUNTIES are predominantly suburban, offering a wide variety of wealthy homes and estates, middle and lower-middle-class housing, tree-lined streets, shopping malls, parks and scattered industrial locales. The Meadowlands Sports Complex in East Rutherford (Bergen County) is comprised of Giants Stadium, the Izod Center (home of the New Jersey Nets), and the Meadowlands Racetrack. Rutgers, the State University, is located in New Brunswick and Piscataway (Middlesex County). MORRIS COUNTY is notable for its county seat, Morristown, and the many charming small towns along Route 24. The county has historical significance dating back to Revolutionary times and George Washington’s encampment in what is now Morristown National Park. The Great Swamp National Wildlife Refuge is a large wilderness area in the midst of the suburbs. WARREN and SUSSEX COUNTIES fall within the mountain and lake regions of New Jersey. They are predominantly rural, dotted with small towns, quaint shops, older homes, country estates, and cabins. The Delaware Water Gap, with its huge cliffs and rushing waters, is spectacularly scenic. Vernon, in Sussex County, is home to the state’s largest ski resort. SOMERSET and HUNTERDON COUNTIES consist of rolling farmland, quaint, rural towns, suburban communities and some very large and extravagant estate homes. Somerset County is in the heart of New Jersey’s horse country, Hunterdon contains the state’s only covered bridge and some of the most picturesque farmland available. MERCER COUNTY is part suburban, part rural. Princeton, with its Gothic architecture and ivy-covered walls, is reminiscent of Oxford, England. It is home to the prestigious Princeton University as well as some of the country’s foremost research facilities. MONMOUTH, OCEAN and ATLANTIC COUNTIES constitute most of the New Jersey shore region, containing miles of beachfront and boardwalk, amusement areas, harbors, marinas and lighthouses. Many beach communities, cottages and bungalows can be found in these coastal areas. Monmouth County contains many large, elegant homes, a commercial fishery, and the PNC Arts Center, the large amphitheater that has been one of New Jersey’s most successful concert venues. Atlantic City is the foremost tourist destination in New Jersey, offering glitzy hotel/casinos and world-class entertainment. BURLINGTON COUNTY is in the heart of The Pine Barrens, a huge wilderness area with dense forest, scenic rivers, and swampland. This region contains very small, rural communities whose native inhabitants hare a unique, Ozark-like culture and folklore. Burlington County also has an industrial section located in and around Burlington City. CAMDEN COUNTY offers a variety of sites just minutes from Philadelphia. The city of Camden is the county seat and its urban center. The revitalized waterfront area is home to the New Jersey State Aquarium and the Susquehanna Bank Center, South Jersey’s premiere concert venue. Cherry Hill is a wealthy suburban community with large, expensive homes. SALEM, GLOUCESTER and CUMBERLAND COUNTIES are predominantly rural in nature. Farms and small communities abound. Gloucester County has suburban areas as well. CAPE MAY COUNTY is the southernmost county in New Jersey, part of which is located below the Mason-Dixon line. It contains popular shore resort communities such as Wildwood and Ocean City, laden with boardwalk style shops, amusements and rides. Cape May City is a quaint Victorian paradise, featuring architecturally magnificent bed-and-breakfast establishments and charming shopping areas.

To enter the United States on a temporary basis to work, be employed, and/or be paid by a US-based company as a skilled or unskilled worker, a temporary worker type of visa is required. Temporary Entertainment Work Visas are O and P. In these situations, the prospective employer must file with US Citizenship & Immigration Services (USCIS) on behalf of the foreign prospective employee, a non-immigrant visa petition accompanied by an approved labor certification. After petition approval, applicant must make visa application at the US Embassy in their country of origin. The applicant will be interviewed and evaluated.

Tax breaks/incentives
20% Tax Credit Program - New Jersey offers a tax credit in an amount equal to 20% of qualified production expenses, available to production companies meeting certain criteria, chiefly: (1) At least 60% of the total expenses of a project, exclusive of post-production costs, will be incurred for services performed and goods used or consumed in New Jersey; (2) Principal photography of a project commences within 150 days after the approval of the application for the credit. Exemption from 7% Sales Tax - Certain tangible property used directly and primarily in the production of films and television programs is exempt from 7% sales tax. This tangible property includes the purchase of replacement parts for machinery, tools and other supplies, the purchase of lumber and hardware to build sets, the rental of picture cars, the purchase or rental of other types of props, and costs related to the repair of camera and lighting equipment.

Introduction
New Mexico encompasses 121,598 square miles. With one of the lowest population densities of 12.4 persons per square mile it is easy to understand the vast immensity and diversity of terrain that has coined "Land of Enchantment" as New Mexico's nickname. With active and experienced production crews and talent, the cities of Albuquerque, Santa Fe, Zia Pueblo, Taos, Abiquiu, Alamogordo, Las Cruces and their surroundings have achieved numerous urban, high-tech, southwestern and even lunar production looks. With the Rocky Mountains traversing the entire State north to south, their highest point in New Mexico is Wheeler Peak, at 13,361 ft near Taos. Landscapes with meandering roads, desert, high mountain alpine, rivers and streams, western ranches and sets all exist in a State where shooting vistas of 360 degrees uninterrupted is not uncommon. Permits/visas
We try to keep permits to a minimum but Oklahoma Film Commission will help you acquire the permits you will need for your production. Most permits are free, but there are a few with a minimal cost.

Tax breaks/incentives
The Oklahoma Film Enhancement Rebate offers up to 15% on Oklahoma expenditures to qualifying companies filming in the state capped at $5 million per year. Specifics: (1) The rebate is extended to film, television and commercial productions. (2) Company must have a minimum budget of $500,000 and spend $300,000 in Oklahoma. The minimum budget requirement is cumulative so companies producing multiple projects in a fiscal year with a minimum budget of $250,000 and totaling at least $500,000 will qualify. (3) Company must employ Oklahoma residents for at least 50% of its below-the-line crew to qualify for full 15% rebate. Rebates of 5% are available if a company employs up to 24% Oklahomans and 10% for companies who employ 25 to 49% Oklahomans. Crew tiers are waived if (a) the budget is $5 million or higher, or (b) with a signed letter from the Director of the Oklahoma Film & Music Office verifying that inquiries have been made and there is not adequate crew available at the time required. (4) The hiring of Oklahoma expatriates counts toward the tier requirements and the $300,000 Oklahoma expenditure requirement. (5) Company must provide proof of complete financing prior to commencement of principal photography. If film is not bonded, no rebate money will be released until evidence is provided that all Oklahoma crew and vendors have been paid along with evidence that there are no liens against production company in the state of Oklahoma. (6) General liability insurance with minimum coverage of $1 million, and workers’ compensation policy pursuant to state law are required. (7) Rebate may include public/private donations and contributions received for benefit of fund. (8) Company shall provide evidence of a recognizable domestic or foreign distribution agreement within one year from the end of principal photography or must provide evidence of being accepted to one of the top fifteen film festivals or two or more of the top thirty film festivals in the U.S. as determined by the Oklahoma Film & Music Office. (Top 30 list based on industry polling and research). (9) Company required to secure no-cost filming permit from the Oklahoma Film & Music Office. (10) Rebate is payable on or after July 1 following the fiscal year in which documented expenditures were made. Note: The 15% rebate cannot be used in conjunction with the POP tax exemption. Point of Purchase Tax Exemption to qualified productions on sales taxes paid for property or services to be used in productions. There is no minimum budget or expenditure requirement. The state’s current sales tax is 4.5%. Local taxes average between 3% and 4%. Note: The POP tax exemption cannot be used in conjunction with the 15% rebate. Tax Credit for Oklahoma Film & Music Projects gives state taxpayers investing in film or music projects produced in Oklahoma a 25% income tax credit on profits made when those profits are reinvested in another film or music project produced in Oklahoma. Credit cannot exceed Oklahoma taxpayer's liability. Credit is non-assignable and non-transferable. Tax Credit for Construction of Oklahoma Film & Music Facilities offers companies building production facilities state income tax credits ranging from 10% on a minimum $500,000 construction project to 25% for projects over $1 million. Credit cannot exceed Oklahoma taxpayer's liability. Credit is non- assignable and non-transferable.

All companies are required to register their motion picture, television, commercial or still photography projects with the Rhode Island Film & Television Office. Non-compliance could result in shutdown of production. Film permit requests should be submitted 30 days in advance to allow time for processing.

Tax breaks/incentives
Motion Picture Production Tax Credit - 25% of state-certified production costs incurred directly attributable to activity within the state i.e. any pre-production, production and post-production cost that a motion picture production company incurs and pays to the extent that it occurs within the state of RI. Local spend includes foreigners working in RI and per diems, but not finance fees nor bond fees. A "state-certified production" means a motion picture production approved by the RI Film & TV Office and produced by a motion picture production company domiciled in RI, whether or not such company owns or controls the copyright and distribution rights in the motion picture, provided that such company has either a signed viable distribution plan, or is producing the motion picture for: a major motion picture distributor, a major theatrical exhibitor, a television network or a cable television programmer. The film needs to be shot primarily in RI, meaning that 51% of principal photography must take place in RI. A minimum of $300,000 needs to be spent on the ground in RI. Travelling into the State of RI counts toward the production costs but travelling away from the State does not count.A transparent policy is in place and is predictable. The application process is as follows: the company fills in the initial application and provides supplemental material; the RI Film & TV Office reviews the application and sends a letter, certifying the production; when the production is completed in RI, the company sends the final application and a cost report, state certified audit in the form of an opinion, a letter of good standing from the RI Division of Taxation, and other supplemental material; upon reviewing the final application and material, the RI Film & TV Office will issue film tax credits. Credits are typically distributed 30-60 days after the final application and supplemental material have been approved. There is no cap. The tax credit is a credit against state taxes. An independent, state certified RI accountant must certify the audit, and render an opinion. Sales tax is not recoverable.

Introduction
West Virginia is well known for its hospitality and works hard to protect its wonderful reputation. Because of West Virginia's rich history, cultural significance, and famous residents, national, regional, and local television commercials, reality shows, and independent film and video productions are shot in West Virginia every year. Numerous major motion pictures have shot on location in West Virginia to capture the state's unique towns, historical settings, and immeasurable beauty. And many dramatic features have been produced using stories with West Virginia origins, such as "We Are Marshall" (also filmed in WV), "A Beautiful Mind", "The Mothman Prophecies", "October Sky", and "Patch Adams".


Permits/visas
These vary by region, but when permits are required, it is a simple process. It is best to consult the Film Office to ensure proper protocol is followed. Advance notice is required for filming on state and federal properties. Most state-owned property is fee-free, but cost recovery may occur for services, staff, or equipment used, and based upon the extent of facilities used, disruption of normal services, or special needs requested (for example, road closures), fees may also be charged. All projects are evaluated on a case-by-case basis.

Tax breaks/incentives
Transferable Tax Credit - up to 31% transferable tax credits (with 2-year carry forward) on direct production and post-production in-state spend (minimum spend $25,000; no caps per project but annual funding limited to $10 million). Sales Tax Exemptions - qualified in-state purchases and rentals of tangible personal property directly used in production, and in-state purchases of services directly used in production, are exempt from the 6% Consumers Sales and Service Tax. Lodging Exemptions - exemption from the 6% Consumers Sales and Service Tax and exemption from the Local Hotel/Motel Tax (varies per region) on lodging stays in excess of 30 consecutive days per person at the same facility. "River On Demand" - a complimentary service made possible by the drawdown of Summersville Lake by the US Army Corps of Engineers, the flow of the Gauley River can be modulated to suit productions during November (on occasion, during other times as well). Discount Vehicle Rentals - Enterprise Rent-A-Car's West Virginia locations will provide production scouts (who have been retained by a motion picture studio) a 50% discount off retail rates when scouting locations within West Virginia for potential film productions. Enterprise will also provide volume discounts for any motion picture studio filming within West Virginia. Contact the film office to learn how to take advantage of this incentive.

Introduction
Wisconsin has over 15,000 lakes with miles of rivers and streams, sandstone cliffs, sandy beaches, forests, farmland and a coastline with lighthouses and pretty villages. The solid working relationship between the Film Office, regional film liaisons and city and State government agencies has created a state ready and willing to support local and visiting filmmakers in all efforts to create successful on-location film productions.

Tax breaks/incentives
Wisconsin's 25% Film Tax Credit Program provides two types of tax credits: Film Production Services Credit provides tax credits for salary and wages of Wisconsin residents, production expenditures and sales tax. To qualify, the production must be pre-accredited by the department. Film Production Company Investment Credit provides credits to film production companies doing business in Wisconsin of up to 15% of expenditures for tangible personal property and for the purchase, construction, rehabilitation, remodeling or repair of real property used for film production. Film Production Services Credit - to be eligible, a claimant must: be a film production company; operate an "accredited production" in the state; own the copyright in the accredited production or have contracted directly with the copyright owner or a person acting on the owner's behalf; and have a viable plan for the commercial distribution of the finished production. An "accredited production" must: be a film, video, electronic game, broadcast advertisement, or television production; and have $50,000 (for a production less than 30 minutes) or $100,000 (for a production 30 minutes or longer) in salaries and wages of all of the eligible claimant's employees included in the cost of production for the period ending 12 months after the month in which the principal filming or taping of the production begins. Accredited productions do not include the following: news, current events, or public programming (including public programming of a civic or governmental function) or a program that includes weather or market reports; a talk show; a production with respect to a questionnaire or contest.; a sports event or sports activity (however, a travel promotion that addresses a sports event or sports activity is eligible. A sports event or sports activity that is exclusively competitive in nature is not eligible); a gala presentation or awards show.; a finished production that solicits funds.; a production for which the production company is required under 18 U.S.C. 2257 to maintain records with respect to a performer portrayed in a single media or multimedia program; a production produced primarily for industrial, corporate, or institutional purposes. In determining whether to accredit a production, the Department of Commerce considers whether the production would: occur in Wisconsin without the tax credits; enhance economic development in Wisconsin; enhance the potential for increasing the film, video, or electronic game industry in Wisconsin; hurt the reputation of the state of Wisconsin. Eligible expenditures: (1) salaries or wages paid to WI residents; (2) production expenditures; and (3) Wisconsin sales tax. All credits (whether Non-refundable and refundable) are non-transferable. 25% of salary and wages paid to WI residents (non-fundable). Non-refundable credit equal to 25% of the salaries or wages paid by the claimant to the claimant's employees who were residents of Wisconsin at the time they were paid for services rendered in Wisconsin to produce an accredited production. The maximum credit per employee is $25,000, and the salary or wages of the two highest paid employees cannot be counted. A Wisconsin resident is a person with the intent to live in Wisconsin permanently or indefinitely. This non-refundable, nontransferable credit can be carried forward for up to 15 years to offset Wisconsin income tax liability. Production Expenditures (refundable). Refundable credit equal to 25% of eligible production expenditures paid by the claimant in the taxable year to produce an accredited production. Production Expenditures are expenditures that are incurred in Wisconsin and directly used to produce an accredited production. Production Expenditures include: set construction and operation, wardrobes, make-up, clothing accessories, photography, sound recording, sound synchronization, sound mixing, lighting, editing, film processing, film transferring, special effects, visual effects, renting or leasing facilities or equipment, renting or leasing motor vehicles, food, lodging, and any other similar expenditure as determined by the Department of Commerce; music performed, composed, or recorded by a musician who is a resident of Wisconsin, or published, or distributed by an entity that has its headquarters in Wisconsin; air travel purchased from a travel agency or company that has its headquarters in Wisconsin; insurance purchased from an insurance agency or company that has its headquarters in Wisconsin. Peroduction Expenditurse do not Include: talent; marketing or distribution of an accredited production; "Incurred in Wisconsin" does not mean that accredited productions must buy from Wisconsin vendors, except in the cases of music, air travel, and insurance. Purchased services have to be performed in Wisconsin for exclusive use on the qualified production, but do not have to be purchased from a Wisconsin provider. Non-resident wages and salaries for services provided directly for the accredited production in Wisconsin and paid by another entity (such as a payroll company) qualify so long as those services are production expenditures (as defined above) and the persons who are providing the services are not employees of the claimant. This is a refundable, but not transferable, credit. Sales Tax Credit (non-refundable). Non-refundable credit equal to the Wisconsin 5.0% sales taxes that the claimant paid in the taxable year on the purchase of tangible personal property and taxable services that were used directly in producing an accredited production in Wisconsin, including all stages of production, from the final script to the distribution of the finished production. This non-refundable, nontransferable credit can be carried forward for up to 15 years to offset Wisconsin income tax liability. Film Production Company Investment Credit - To be eligible, a claimant must be a "film production company', which is defined as an entity that creates films, videos, electronic games, broadcast advertisements, or television productions, not including the productions specifically excluded for the Film Production Services Tax Credit. Eligible Expenditures: For the first three taxable years that an eligible claimant is doing business in Wisconsin as a film production company, the claimant can claim an amount equal to 15% of the following that the claimant paid in the taxable year to establish a film production company in Wisconsin: the purchase price of depreciable, tangible personal property, such as business equipment or vehicles. At least 50% of the property's use must be for the claimant's business as a film production company; the amount spent to construct, rehabilitate, remodel, or repair real property, if the claimant began the physical work of construction, rehabilitation, remodeling, or repair, or any demolition or destruction in preparation for the physical work, after December 31, 2007, or if the completed project is placed in service after December 31, 2007. Also, the amount spent to acquire real property, if the property is not previously owned property, and if the claimant acquires the property after December 31, 2007, or if the completed project is placed in service after December 31, 2007. "Physical work" does not include preliminary activities such as planning, designing, securing financing, researching, developing specifications, or stabilizing property to prevent deterioration. "Previously owned property" means real property that the claimant or a related person owned during the two years prior to doing business in Wisconsin as a film production company, and for which the claimant may not deduct a loss from the sale of the property to, or an exchange of the property with, the related person as defined under the federal Internal Revenue Code. In determining whether to award Film Production Investment Credits to an eligible claimant, the department will consider: whether the film production company would not be estasblished in Wisconsin without the tax credits; whether the film production company will enhance economic development in Wisconsin; whether the film production company will enhance the potential for increasing the film, video, or electronic game industry in Wisconsin.
